CARRIAGE INDUSTRY BILL SLATED FOR VOTE MONDAY DECEMBER 21st Urgent - Please take
action now - see below







The purpose of this special alert is to ask you to contact your Council Members
to ask them to vote against Intro 653A. Click here for the text of the bill.
This bill is a disaster for the horses. I will be sending this notice out
several times this next week, so please bear with us as we implore all of you to
take this necessary action.
Intro 653A is a carriage industry bill that must be opposed. The bill is likely
to come up for a full council vote on December 21, 2009. Please contact your
Council Member and ask that they vote against this bill for the reasons listed
below. Because of the time factor, we are asking you to do three things :

Call your Council Member's office
Send a letter by fax and/or snail mail - but it must be done now
Base your letter on the reasons listed below.
Send an e-mail to enforce the above. However, e-mails are the least effective
means of communication since many bounce and are not checked by the council
offices.
The Council web site is www.council. nyc.gov. Click on "Council Members" to the
left. You will come to a page where all the members are listed. If you do not
know your Council Member , enter your address to find out.
Ask your Council Member to vote against Intro 653A, the bill that would amend
the administrative code in regard to horse-drawn cabs.
In addition to your own council member, contact Speaker Christine Quinn. Let her
know how inappropriate the bill is and that she should not attempt to push it
through the council.
Always say that you support a full ban of the carriage trade. It is both
inhumane and unsafe. If you live outside New York City, please contact Speaker
Christine Quinn. If you are so inclined, also contact the other Council Members.

  This must not be allowed to continue!

REASONS TO OPPOSE THIS BILL use as a guide for your phone calls and letters









Rate Increase: The bill would provide a rate increase to the drivers. Although
they have technically not had a raise in 15 years, they cheat on the street by
overcharging tourists and charge huge amounts on their web sites - up to $175
for a ride. This is all illegal but the drivers do it with impunity since the
oversight agencies look the other way. The Council now wants to reward them for
this larceny. They have given themselves their own raise and will most likely
continue to charge more on the streets and their web sites whether or not they
get this increase. The increase represents a 240% jump over the current rate. No
amount will ever be enough and the City should not support and reward fraud. See

No Improvements: The Bill seeks to give the drivers a raise but turns its back
on the sub standard stables such as West Side Livery on W. 38th St. See this

. This bill is all about the drivers getting more and the horses getting less.
The horses will still work 9 hours a day in heavy traffic, in hot humid weather
or freezing cold; they will still come back to small stalls accessed by steep
ramps. Although horses need daily turnout, they will not get it under this bill.
UNENFORCEABLE WINDOW DRESSING --
Age at Purchase: the bill seeks to pull the proverbial wool over the eyes by
pretending to care about the horses. It states that horses must be at least five
years old at purchase and no older than 20. But it says nothing about the age at
which a horse must retire. It is also very difficult to determine the age of
horses so this section is meaningless. Holly Cheever, DVM and equine expert,
states that the "old- age cutoff can vary enormously based on the health,
genetics and care of the individual horse. Especially when they come through the
killer (horse slaughter) sales, the ages of horses tend to be inaccurate. Rarely
does a horse for sale have any corroborating papers and tattoos to affirm this
age. I would get horses off the street by the age of 20." Within the last year,
a working horse at one of the stables died and was listed as 33 years old.
Rest for Horses : the bill calls for 35 days of nonconsecutive rest per year for
each horse. This is clearly a ruse since horse experts concur that horses
(particularly working horses) need daily turnout, which they presently do not
get. There is no consideration for the other 330 days the horses where they are
confined between the shafts of their carriage for nine hours a day only to
return to their stables where there is no opportunity to graze in pastures and
socialize with other horses - something so important for herd animals. In
addition, there is no way to enforce this part of the bill so it is also
meaningless.
The City of NY will pay for water for horses, while laying off City workers. We
have complained for years that the horses do not have access to year round water
in the park. This bill seeks to have the city pay for piping to provide this
water. The industry should pay for it. It is irresponsible to support a bill
that will incur city expenditures to support a controversial private industry,
which should not be subsidized by the city.
Bridles and halters required on working horses: but drivers will be allowed to
continue to use their cell phones to talk and text , and read newspapers while
working; they will still be allowed to make u-turns in heavily congested streets
with impunity.

We have been getting numerous calls in regards to the 84 horses
confiscated in Cannon County, Tennessee.

At this time HHT is not caring for any of these animals at our
facility in Knoxville. They are all being cared for in the Nashville
area by HSUS, State Vets and volunteers.

FEPAEX DECLINA LA INVITACIÓN DEL PRESIDENTE



Desde la Federación de Protectoras de Animales de Extremadura (FEPAEX)
declinamos cortésmente la invitación que nos hace el Presidente Fernández
Vara para "la organización de una gran manifestación en nuestra región que
sirva de acicate a una apuesta decidida por cambiar las cosas en sensibilidad
social".



Agradecemos la invitación pero no podemos aceptarla, entre otras cosas, porque
no creemos que una manifestación, por muy masiva que sea, cambie la conciencia
del que no la tiene.



Tampoco creemos que en Extremadura falte sensibilidad hacia el tema del maltrato
a los animales. Somos muchos los extremeños que la tenemos pero, como siempre,
la mayoría silenciosa. Mayoría que no encuentra el respaldo y el apoyo de las
instituciones para denunciar hechos tan repugnantes como el de Torreorgaz y que
tiene que soportar "las mal llamadas gamberradas de los quintos" por la
impunidad existente y la tolerancia y dejadez de las administraciones.



Fepaex ya se concentró el jueves 29 en Badajoz para condenar la horrible
mutilación de los cachorros y, en ese mismo instante, mientras manifestábamos
nuestra indignación por lo ocurrido, los "quintos" estaban robando "tal
como exige la tradición" a la pobre burrita vieja en Torreorgaz para
divertirse con su sufrimiento hasta la muerte.



La mayoría sensibilizada de Extremadura no necesita manifestarse, lo que
necesitamos YA es que se aplique la Ley 5/2002 de Protección de los Animales de
Extremadura y que las administraciones asuman su responsabilidad. Estamos de
acuerdo en que La Ley es mejorable, pero no podemos decir que hay que cambiarla
cuando aún no se ha llevado a la práctica y ni siquiera se ha desarrollado su
Reglamento. Sólo con que se tomaran la molestia, en la Consejería de
Agricultura, de aplicar el Régimen Sancionador e imponer las multas que la Ley
contempla, cambiaríamos la sensibilidad de esta minoría de insensibles
extremeños. Minoría que tiene amedrentada a la mayoría sensible y que ofrece
al exterior esta vergonzosa imagen de Extremadura.



Lo que necesitamos en nuestra Comunidad para acabar con esta lacra es un cambio
de conciencia y actitud en nuestros gobernantes hacia el maltrato animal, la
voluntad política de que esto termine y, sobretodo, NECESITAMOS HECHOS NO
PALABRAS.



La pelota la ponemos en el tejado de nuestro Presidente, el responsable último
de la protección de los animales en Extremadura. En sus manos está la
sensibilización de los insensibles, el sistema educativo de nuestros niños y
jóvenes, la capacidad sancionadora y reguladora. El problema está en manos de
quien tiene los medios humanos, económicos, la autoridad y la responsabilidad
de resolverlo. Los cambios que necesitamos en Extremadura están en sus manos
Sr. Presidente.



En cuanto a que no nos ensañemos con "los quintos", queremos que toda
Extremadura sepa que haremos lo POSIBLE Y LO IMPOSIBLE para que la muerte de la
burrita vieja de Torreorgaz no quede impune. Todavía no sabemos cuántas
denuncias tenemos que presentar, ni a quién o quiénes denunciar, ni dónde; no
nos preocupa, tenemos el tiempo necesario para hacerlo, la asesoría jurídica
de expertos y la indignación, el asco y el dolor necesarios para llegar hasta
sus últimas consecuencias.



Y por último, queremos agradecer a la familia que denunció el valor que tuvo
al hacerlo, y esperamos que sea arropada por sus autoridades, y por toda la
gente de bien y con conciencia que sabemos que vive en Torreorgaz.

Boot for stable threatens doom to Central Park horse carriages

A quarter of Central Park's carriage horses will be left without a place to hit
the hay this holiday season -- and could lose their Manhattan home forever.
The city has ordered Shamrock Stables to hoof it out of the municipal-owned
building it occupies on West 45th Street next month.
The city's Housing Preservation and Development agency wants to tear down the
stable to make room for affordable housing.
Now Shamrock's 17 carriage owners -- and 32 horses -- are jockeying for new
digs.
But Manhattan's four other stables operate at capacity during the holidays,
drivers told The Post.

STALL ORDER: The city has ordered the Shamrock Stables (above) to shut down
before the end of the year.


That means 25 percent of the city's 68 carriages could be out of commission at a
time of peak demand -- and it means longer lines for tourists who count a
horse-and-buggy ride in Central Park as a "must-do" holiday experience.
For the drivers, it spells financial disaster. They count on the Christmas
business to get through the lean months that follow.
"This is my life. I can't imagine that there would be no place in the city for
these horses," said Shamrock Stables owner Ian McKeever, who got the marching
orders last week and broke the bleak news to the carriage drivers Friday
morning.
"I'm actively working with the city and hopefully can come up with a solution
that's good for them and for Shamrock," said McKeever, who started in the
carriage business when he emigrated from Ireland in 1985.
Driver Pedro Tapia struggled with the news as he and his horse, Beauty, left the
stables for Central Park.
"I love this job. I grew up on a farm in Mexico, and we always had horses," said
Tapia. "I've got five family members in this business. I don't know what we'd do
without it."
Stable boarder Brendan McMahon said the bulk of the carriage owners, many of
them second-generation Irish, Italian and Polish horse enthusiasts, support
their families on earnings that average between $30,000 and $40,000 a year.
"It's not a second job for most of them or an extra bit of income," he said.
"This is a really serious blow to about 23 families just before Christmas. It's
a trust issue. I really feel we're being abandoned."
Many of the horses boarded at Shamrock are familiar to the schoolchildren who go
to PS 51 next door -- and to fans of "Sex and the City" and "Law & Order."
McKeever's favorite horse, Roger, a bright chestnut with a gentle disposition
who was rescued from an abusive farm owner, has appeared on both shows, and "Law
& Order" has filmed at the stable several times.

 
The city moved the 41-year-old stable, Manhattan's oldest, to its current
location in 2000 after taking over its original space, on East 61st Street at
York Avenue, for FDR Drive construction.
Shamrock wasn't given a lease but has gotten a rent bill from the city each
month the last nine years -- all promptly paid.
In 2005, according to the Department of Housing Preservation and Development,
the entire block was rezoned. The city laid out its plans for a major
development that would expand PS 51, build 1,300 affordable-housing units where
the stables stand and add 10,000 feet of retail space to the neighborhood.

The stable was told it would eventually have to move but was not given a
deadline, the city said.
"This project has been in the works for years, and it's an amazing opportunity
and investment that will help transform this neighborhood and pay dividends for
years to come," said Housing spokesman Eric Bederman. "When the stable came to
this location, it was understood that this wasn't meant to be a permanent home
and that at some point they would have to move."
But McKeever said he was "blindsided" when he was told last week that he had
just weeks to get out.
"Eight months ago, they said it would be years and years before the site was
developed," he said. "Six weeks ago, we were told there were no development
plans yet on the site."
McKeever said he was told by a Housing official to be out by mid-December. The
city told The Post the stable had until the end of the year.
The city also said it did an impact study and found there was room at other
stables -- but calls by The Post indicate the Shamrock horses are likely to be
out of luck.
Stall space is almost impossible to come by for the next three months, drivers
said. In high season, horses work only five hours because they are doing more
rides. To avoid straining them, drivers swap them out more frequently. As more
horses are brought into Manhattan to fill these holiday shifts, stable space
dries up.
"We'd be surprised if we could get three horses in the other stables," said
Shamrock spokeswoman Carolyn Daly.
Even if some horses succeed in finding berths elsewhere, it'll be next to
impossible for McKeever to find a new stable without help from the city. It has
to be large enough for his horses -- plus the 700 bales of hay the horses eat
every two weeks, tons of 50-pound bags of feed and sawdust, the 17 carriages,
tack and other equipment.
The horses can't be lodged too far from Central Park and require special
ventilation, since they can't tolerate air conditioning or modern heating.
Paying market rent would devastate his business, McKeever said, since carriage
drivers haven't had a raise since 1989. They can charge only $34 per ride.
In the past, the city has mulled building stables at 85th Street inside Central
Park, a solution that carriage drivers and even industry critics support.
But some residents would like to see the horses put out to pasture for good.
"At most, there should be four allowed to circle the park, but that's it," said
skin-care expert Nicole Pozzetti, who works near 59th Street. "I'm tired of
coming to work with poo on my shoe. It's on the streets every day, and they just
throw some hay over it."
Others, however, remain entranced by the romantic aura of old New York that the
horse-and-buggies create.
Said Alex Genoa, a security guard near Central Park: "It makes the city
special."

Issues arise with TRNP wild horses at auction

A wild-horse auction turned chaotic when a stud tried to jump a fence, another
horse escaped during loading into a trailer and another reportedly died Friday
afternoon in Dickinson.
To control population and administer a research contraceptive, wild horses in
Theodore Roosevelt National Park near Medora were rounded up earlier this week
and sold at auction Friday at Stockmen's Livestock Exchange. The auction was
moving quickly when bidding on Bashful, a 2-year-old stud, began and about four
minutes into his bidding, things came to a screeching halt. After being tapped
on the rear by a ring attendant's flag, an anxiety-ridden Bashful attempted to
jump a 6-foot fence separating him from the crowd. Screams erupted and people
began to scramble. As the horse was struggling to get his rear portion over the
fence, his rear right leg became entangled between thick wires. The horse began
to violently thrash in an attempt to break free, biting anything in its way.
Bystanders said the horse's front legs knocked an elderly man to the ground. As
the horse began thrashing, its front legs stomped the man. "He landed in the
crowd, then crawled over
  it (fence) and then he was in the first walkway and he was just stomping and
kicking because the man was underneath him," said Dan Sparling of Bismarck, a
witness to the incident.
Larry Schnell, manager of Stockmen's Livestock Exchange, said he was unaware if
anyone was hurt, but had heard reports. Stark County Sheriff Clarence Tuhy said
a man was transported to the hospital in an ambulance. No tranquilizers, rope or
wire cutters were on hand to assist in freeing the horse. "I've been doing this
for 35 years and I don't remember anything close to that happening," Schnell
said. Status of the injured man is unknown. Some people experienced with wild
horses feel the event could have been handled differently. "Anybody that's got a
little common sense, you don't start bringing these wild horses in," said Frank
Kuntz, executive vice president of the Nokota Horse Conservancy, a nonprofit
group aimed at wild-horse preservation. "Bring them in separate. Plus, who knows
how these guys are handling them out back? They should have the fence higher.
It's total stupidity and total inexperience. "
Horses were dropped off at the livestock yard Thursday afternoon, said Valerie
Naylor, TRNP superintendent. "They bring them here to the sale barn, turn them
loose to these guys and leave," Kuntz said. Rev. James Kilzer of Richardton said
one buyer who loaded his newly purchased horse into a trailer found it dead a
short time later. "The buyer checked for breath ... the horse died of shock,"
Kilzer said. Calls to Dr. John Rowe, a veterinarian on hand during the auction,
went unreturned. Later, a gray mare escaped a corral while being loaded into a
trailer. Several people went after her with trucks and on foot. Michael Sparling
of Bismarck, who didn't intend to buy a horse at the auction, purchased Bashful
for $35 with plans to rehabilitate and train the horse using a natural training
method. "A horse like this, you should never trap like that," Sparling said.
Patty Griffith, a horse trainer from Toppenish, Wash., plans to train the 11
horses she and her
  husband purchased. Griffith has attended several wild-horse auctions and said
horses and protocol at the auction could have been handled better. "Those horses
wouldn't even be rattled if they didn't come along with those fly swatter things
and scare them," Griffith said. "They are in a hurry. They're doing their job,
but these aren't cows."
The horses sold for prices ranging from $35 to more than $1,400, surprising
many. "The prices were much higher than we expected," said Marylu Weber, a
volunteer for the roundup and a member of Nokota Horse Association, another
wild-horse preservation organization. "This is phenomenal prices for these
horses," said horse buyer Nola Robson of Hayfield, Minn. Naylor said 77 horses
were sent to auction and 77 were sent back into the park, including most of the
breeding-age mares. "Everything went very well," Naylor said. "It's unfortunate
this had to happen at the sale."

Los servicios han sido movilizados para rescatar un caballo atascado, en
Marennes (Charente-Maritime) .
Los référentes de protección  animalista y el Grupo de Salvataje costero de Sdis
17 han sido llamados muy rápidamente de refuerzo para el rescate del animal
cogido en la trampa en un canal cenagoso. Durante cerca de nueve horas, los
soldados del fuego trabajaron alrededor del caballo de 17 años de edad, que ha
sido extraído de la poza por medio de una maquina de levantamiento, antes había
sido anestesiado por un veterinario. El animal está bien de salud hoy gracias a
la quincena de bomberos de los centros de socorros de Royan, Saint-Pierre- d'
Oléron, Chateau - De Oléron, Bourcefranc- le-Chapus y Marennes que se
